Interventional research on deceased organ donors and donor organs prior to transplant holds the promise of reducing the number of patients who die waiting for an organ by expanding the pool of transplantable organs and improving transplant outcomes. However, one of the key challenges researchers face is an assumption that someone who receives an organ that was part of an interventional research protocol is always a human subject of that same study. The consequences of this assumption include the need for (...) oversight by an institutional review board and for research-level informed consent from transplant recipients, all within the complex practical realities of the organ donation and transplantation process in the United States. The current national focus on this issue provides an opportunity to think critically about the policy goals of the human subjects regulations and their application to the nascent field of deceased organ donor intervention research. We propose that for donor research where the transplant recipient does not fall under the definition of human subject, the clinical consent model—rather than the consent model used for human research subjects—best facilitates the policy objectives of balancing clinical innovation, transparency, and protection of patients in an ethically responsible and legally compliant manner. The relationship between mental models and ethical decision making, along with the mechanisms through which mental models affect EDM, are not well understood. Using the sensemaking approach to EDM, we empirically tested the relationship of mental models to EDM. Participants were asked to depict their mental models in response to an ethics case to reveal their understanding of the ethical dilemma, and then provide a response, along with a rationale, to a different ethical problem. Findings indicated that complexity of respondents’ (...) mental models was related to EDM, and that this relationship was mediated by sensemaking processes. The implications of these findings for improving integrity training in organizations, as well as ultimately understanding the role of mental models in EDM, are discussed. (shrink)

Any explanation of one fact in terms of another will appeal to some sort of connection between the two. In a causal explanation, the connection might be a causal mechanism or law. But not all explanations are causal, and neither are all explanatory connections. For example, in explaining the fact that a given barn is red in terms of the fact that it is crimson, we might appeal to a non-causal connection between things’ being crimson and their being red. Many (...) such connections, like this one, are general rather than particular. I call these general non-causal explanatory connections 'laws of metaphysics'. In this paper I argue that some of these laws are to be found in the world at its most fundamental level, forming a bridge between fundamental reality and everything else. It is only by admitting fundamental laws, I suggest, that we can do justice to the explanatory relationship between what is fundamental and what is not. And once these laws are admitted, we are able to provide a nice resolution of the puzzle of why there are any non-fundamental facts in the first place. (shrink)

We argue that planning and control may not be separable entities, either at the behavioural level or at the neurophysiological level. We review studies that show the involvement of superior and inferior parietal cortex in both planning and control. We propose an alternative view to the localization theory put forth by Glover.

Problem: Visions of technology, future scenarios, guiding visions represent imaginations of future states of affairs that play a functional role in processes of technological research, development and innovation—e.g. as a means to create attention, communication, coordination, or for the strategic exertion of influence. Since a couple of years there is a growing attention for such imaginations of futures in politics, the economy, research and the civil society. This trend concerns technology assessment as an observer of these processes and a consultant (...) on the implications of technology and innovation. TA faces increasing demands to assess imaginations of futures that circulate in the present and to participate in shaping these through scenarios or foresights. More than ever, this raises the question, which propositions can be made based on these imaginations by TA and how this can be used in advisory practices. Imaginations of futures are relevant for TA not as predictions but in their significance and effectiveness in the present, which need to be understood and assessed.Contents: This discussion paper outlines how present significance and effects of imagined futures in technological research and innovation processes can be conceived and analyzed. In this paper, all forms of imaginations of technology futures will be called “socio-technical futures” because within them technological developments and social changes are interwoven and inseparably interrelated. In this paper, we discuss why TA should analyze socio-technical futures, how such analyses can grasp the societal conditions that are expressed in the imagined futures and how these become effective in processes of technology development, communication, decision making etc. We raise the question which self-reflexive positioning or possible realignment of TA is needed as a response to its increased concern with assessing and even co-producing socio-technical futures. The latter is often demanded regarding the growing attention by politics and publics to imaginations of futures with wide temporal and spatial reach.Addressee of this paper is the TA community in a broader sense. The aim is to sensitize colleagues for the topic and its challenges, to consolidate discussions and to provide theoretical and methodical suggestions for research in TA and related advisory practices with respect to socio-technical futures. This paper has been originally initiated during the workshop “The present of technological futures-theoretical and methodical challenges for Technology Assessment”, in which all of the paper’s authors participated. This paper explores the analysis of ability, where ability is to be understood in the epistemic sense—in contrast to what might be called a causal sense. There are plenty of cases where an agent is able to perform an action that guarantees a given result even though she does not know which of her actions guarantees that result. Such an agent possesses the causal ability but lacks the epistemic ability. The standard analysis of such epistemic abilities relies on the notion (...) of action types—as opposed to action tokens—and then posits that an agent has the epistemic ability to do something if and only if there is an action type available to her that she knows guarantees it. We show that these action types are not needed: we present a formalism without action types that can simulate analyzes of epistemic ability that rely on action types. Our formalism is a standard epistemic extension of the theory of “seeing to it that”, which arose from a modal tradition in the logic of action. (shrink)

Recent years have seen an explosion of interest in metaphysical explanation, and philosophers have fixed on the notion of ground as the conceptual tool with which such explanation should be investigated. I will argue that this focus on ground is myopic and that some metaphysical explanations that involve the essences of things cannot be understood in terms of ground. Such ‘essentialist’ explanation is of interest, not only for its ubiquity in philosophy, but for its being in a sense an ultimate (...) form of explanation. I give an account of the sense in which such explanation is ultimate and support it by defending what I call the inessentiality of essence. I close by suggesting that this principle is the key to understanding why essentialist explanations can seem so satisfying. (shrink)

Current orthodoxy in modal logic and metaphysics has it that actuality is non-contingent in the following sense: for all p, if actually, p, then necessarily, actually, p. Call this thesis (Actuality) Necessitism and its negation (Actuality) Contingentism. Thus, according to Contingentism, there is at least one proposition p which is actually true but which could have been actually false. In another paper, one of us (Glazier 2023) has recently defended Contingentism. The present paper explores the logic of actuality under (...) Contingentism. After informally introducing Contingentism and outlining what we take to be the main motivations for accepting it, we consider how contingent actuality should be taken to be. We argue that the nature, or essence, of actuality imposes certain limits on the extent to which actuality could have been different, and these then inform our view of the logic of actuality. Turning to the formal study of the logic of contingent actuality, we specify a formal language and a possible world semantics for that language and distinguish a number of natural notions of validity and consequence to which it gives rise. We present axiomatizations of the different resulting logics and examine the variety of iterated modalities in our systems. We establish soundness and completeness results. (shrink)

I develop a puzzle, the resolution of which, I argue, requires an unfamiliar distinction between two forms or senses of metaphysical modality, each bearing a different relationship to time. In one sense of ‘metaphysically possible’, it is metaphysically possible for it to be a time other than the time it is now; in another sense, this is not metaphysically possible.

Among the most promising options for vindicating Oppenheim and Putnam’s unity of science hypothesis is the ‘Mentaculus’ of Albert and Loewer. I assess whether this promise can be borne out. My focus is on whether the Mentaculus can deliver what Oppenheim and Putnam call the ‘unity of laws’: the reduction of special science laws to the laws of fundamental physics. I conclude that although the Mentaculus may support a fairly strong form of reductionism, it falls short of upholding the unity (...) of laws. (shrink)

Let a priority micro pluralist be someone who holds that particles or other microscopic objects are fundamental. Rivals to priority micro pluralism include priority monism (the view that the only fundamental concrete object is the entire cosmos) as well as the Aristotelian view that some ordinary macroscopic objects are fundamental. Although priority micro pluralism is popular, I show that it encounters great difficulty in even the most straightforward cases. For example, this tennis ball is spherical; how is this fact to (...) be grounded in facts about the microscopic realm? I consider a number of possible answers to this question. The most promising proposals attempt to exploit the close connection emphasized by Kripke between objects and their original material constituents. I argue that these proposals fail. I conclude that it is worth seriously considering alternatives to this sort of pluralism. (shrink)

I survey the philosophical literature on grounding explanation and its connection to metaphysical ground.

Philosophers have observed that metaphysical necessity appears to be a true or real or genuine form of necessity while epistemic necessity does not. Similarly, natural necessity appears genuine while deontic necessity does not. But what is it for a form of necessity to be genuine? I defend an account of genuine necessity in explanatory terms. The genuine forms of necessity, I argue, are those that provide what I call necessitarianexplanation. I discuss the relationship of necessitarian explanation to ground.

Priority monism is the doctrine that there is exactly one substance: the whole concrete cosmos. This paper develops an objection to priority monism. The objection is that although every substance is necessarily a substance, for the priority monist the cosmos is not necessarily a substance. It follows that the cosmos is not a substance and so priority monism is false. The priority monist's pluralist opponent, I argue, can avoid a parallel objection to her view.

Post-war Japan has seen profound and rapid social change and transformation. One of the most visible areas of change in Japan has been medicine, and particularly the ethical practices and policies that guide medical decision-making. The formal discipline of bioethics, Seimei Rinri in Japanese, has grown by leaps and bounds since the late 1970s, when it began to appear in the curriculum and professional activities of Japanese medical schools and philosophy departments. The introduction of bioethics to Japan was timely, as (...) innovation in medicine and technology was evolving in ways that revealed that the intersection of medicine, traditional Japanese values, and new cultural trends was an area of great moral complexity. In its infancy, bioethics in Japan was more or less an import from the United States, where the discipline took its roots. Quickly, however, it became clear that Japan's history and tradition would call for a different approach, and the engagement of slightly different ethical issues. Organ transplantation, for example, sparked much greater controversy in Japan than it ever did in the United States. Today, Japan has one of the most dynamic bioethics programs in the world, and it is one that reflects both traditional Japanese culture and the need for inter-cultural engagement in an increasingly global world. Through a series of original chapters written by bioethicists and covering a range of ethical issues, this anthology shows that, in contrast to previous assumptions, Japanese bioethics has, in fact, taken on an identity that is undoubtedly separate from its American origins. Rich philosophical questions raised by medicine, human subjects research, and psychiatric care are being posed by scholars in a way that reflect Japanese tradition and is no longer simply reflective of, or shaped by, American traditions and philosophical problems. The book highlights and showcases these trends through a series of chapters written by some of the leading scholars in contemporary Japanese bioethics, many of whom were pioneers of the field when it began and are now nearing retirement. Could I have been someone other than who I am? Philosophers from Williams to Nagel to Lewis have been tempted to answer 'yes', but how can we make sense of such a view? I argue that to say that it is contingent who I am is to say that it is contingent what perspective I have, in a distinctively metaphysical sense of perspective.

If the tiles of a mosaic are arranged symmetrically, then the image those tiles constitute must be symmetric as well. This paper formulates and defends the general principle at work in this case: roughly, that a symmetry cannot ground an asymmetry. It is argued that the principle supports strong objections to four metaphysical views: qualitativism, relationalism, the tenseless or ‘B’ theory of time, and comparativism. A response to these objections is developed which appeals to fragmentalism, the view that reality contains (...) facts which are incompatible with one another. But fragmentalism might be thought too bizarre to tolerate, and if it is, then the objections developed in this paper may well be fatal. (shrink)

The book discusses the central notion of logic, the concept of logical consequence, and its model-theoretic definition as truth-preservation in all models. Whether the model-theoretic definition captures the modal and epistemological features of our pre-theoretic notion depends on what models model. The book argues that, given a non-formal understanding of models, the universal quantifier used in the definition of consequence must be restricted: if literally all models had to be considered, no argument would ever be logically valid. A central challenge (...) of the philosophy of logic is therefore to supplement the model-theoretic definition by a criterion for admissible models. The problem of logical constants, so prominent in the current literature on logical consequence, constitutes but a special case of this much more general demarcation problem. The book explores the various dimensions of the problem of admissible interpretations and proposes that the standard views are unjustified or even unjustifiable. As a consequence, it develops a new vision of logic and suggests in particular that our notion of logical consequence is deeply imbued with metaphysics. (shrink)

Democracy and the Divine articulates a democracy that is based on the principle of giving oneself to another. For this project, the author highlights two traditions that rarely have been read side by side or considered seminal to the philosophical idea of democracy: nineteenth-century German romanticism and French postmodernism.

This book examines the conceptual and temporal frames through which modern Western historiography has linked itself to classical antiquity. In doing so, it articulates a genealogical problematic of what history is and a more strictly focused reappraisal of Greek and Roman historical thought. Ancient ideas of history have played a key role in modern debates about history writing, from Kant through Hegel to Nietzsche and Heidegger, and from Friedrich Creuzer through George Grote and Theodor Mommsen to Momigliano and Moses Finley; (...) yet scholarship has paid little attention to the theoretical implications of the reception of these ideas. The essays in this collection cover a wide range of relevant topics and approaches and boast distinguished authors from across Europe in the fields of classics, ancient and modern history and the theory of historiography. Even with a significant increase in representation of minority identities in popular media – especially in stories of speculative fiction – the ways in which inclusivity is designed must be examined, with Lovecraft Country standing as a useful example for this scrutiny. Adapted from a novel of the same name, the show Lovecraft Country swapped the genders and sexualities of a few characters from the book to increase representation. The ways that these swaps reified tropes about diverse identities is the (...) central concern of this analysis. Using Fields and Fields's conceptualization of racecraft as a "mental terrain of pervasive beliefs," this piece seeks to identify how pervasive beliefs and rules about identity were implicated in the series. The characters of Montrose Freeman, Ruby Baptiste, and Christina Braithwhite all undergo gender and/or sexuality swaps in the adaptation from page to screen, but the ways in which stereotypical assumptions around gender and sexuality are preserved in the narrative work mostly to reproduce negative tropes around these identities. This argument details narratives of violence, avoidance, and sacrifice that are given to these gender- and sexuality-swapped characters, and illustrates how, ultimately, these narratives provide detrimental instead of productive representation of diverse identities. In this paper, I provide an account of the wrong that is done to women when everyday people fail to believe allegations of sexual assault made by women. I argue that an everyday person wrongs both the accuser and women causally distant from the accuser when they fail to believe the accuser’s allegation. First, I argue that there are responses that we, as everyday members of society, owe to victims of sexual assault. A condition enabling everyday people to respond in (...) the way owed to victims is that they have an outright belief that the accuser was assaulted. Actively suspending judgement about whether a crime occurred is in tension with the ability to respond to the victim in a way that supports and validates them. When an everyday person fails to have an outright belief in the truth of an allegation, they wrong the accuser because they risk failing to satisfy the conditions enabling them to fulfill their obligation to her. Second, I argue that everyday people wrong women who are causally distant from the accuser because in our social context, women are often treated in particular ways – especially in the sexual domain – because they are women. As a result, when women hear that an everyday person fails to believe a particular allegation, they easily project themselves into the accuser’s position and reasonably worry that if they were to be assaulted, they too would be met with doubt and disbelief by the people in their community. Durkheim's functional and structural sociology is examined with an eye to the two structuralist modes of inquiry that it inspired, French structuralism and British structuralism. French structuralism comes from Levi-Strauss's inverting the basic ideas of Durkheim and others in the French circle, including Marcell Mauss, Robert Hertz, and Ferdinand de Saussure. British structuralism comes from A.R. Radcliffe-Brown's adoption of Durkheimian ideas to ethnographic interpretation and theoretical speculation. French structuralism produced a broad intellectual movement, whereas British structuralism culminated in network analysis, (...) which is beginning only now to become a broad intellectual movement. In both cases, the intellectual children and grandchildren of functionalism may prove to be more influential in sociology and elsewhere than Durkheimian functionalism, the parent. (shrink)

The paper develops an inductive extension of AGM-style belief base revision theory with the aim of formally implementing Freitag’s :254–267, 2015, Dialectica 70:185–200, 2016) solution to Goodman’s paradox. It shows that the paradox dissolves once belief revision takes place on inductively closed belief bases, rather than on belief sets.

It is frequently claimed that the human mind is organized in a modular fashion, a hypothesis linked historically, though not inevitably, to the claim that many aspects of the human mind are innately specified. A specific instance of this line of thought is the proposal of an innately specified geometric module for human reorientation. From a massive modularity position, the reorientation module would be one of a large number that organized the mind. From the core knowledge position, the reorientation module (...) is one of five innate and encapsulated modules that can later be supplemented by use of human language. In this paper, we marshall five lines of evidence that cast doubt on the geometric module hypothesis, unfolded in a series of reasons: (1) Language does not play a necessary role in the integration of feature and geometric cues, although it can be helpful. (2) A model of reorientation requires flexibility to explain variable phenomena. (3) Experience matters over short and long periods. (4) Features are used for true reorientation. (5) The nature of geometric information is not as yet clearly specified. In the final section, we review recent theoretical approaches to the known reorientation phenomena. (shrink)

Empirical studies indicate that business compliance with the UK Modern Slavery Act is disappointing, but they struggle to make sense of this phenomenon. This article offers a novel framework to understand how business organizations construct the meaning of compliance with the UK Modern Slavery Act. Our analysis builds on the endogeneity of law theory developed by Edelman. Empirically, our study is based on the analysis of the modern slavery statements of 10 FTSE 100 (Financial Times Stock Exchange 100 Index) companies (...) in the food and tobacco sector, backed by interviews with business, civil society, and public officers. We offer a dynamic model that draws attention to the role of compliance professionals in framing ambiguous rules and devising a variety of organizational responses to modern slavery law. Contrary to extant research that tends to praise organizations for going “beyond compliance”, our study underlines the risks of managerialization of modern slavery law, whereby merely symbolic structures come to be associated with legal compliance, even when they are ineffective at tackling modern slavery. I explore Martin Heidegger’s figure of the last god found in his middle period of thinking from 1936–1939 centring my analysis on Contributions to Philosophy: Of the Event (Beiträge) and how this conception is messianic in nature. The last god is a particular instantiation of a being among beings rather than representing a literary or philosophical structure that lies ahead in the future. I emphasise the notion of the turning that occurs within Ereignis, a revived playfulness, wherein the lightning-flash (das (...) Blitzen) appears as a trace or guide towards a new beginning. I conclude by investigating the historical and cultural ramifications that the arrival of the last god would have. (shrink)

This Element examines the contemporary literature on essence in connection with the traditional question whether essence lies within or without our world. Section 1 understands this question in terms of a certain distinction, the distinction between active and latent facts. Section 2 steps back to investigate the connections between essence and other philosophical concepts. Section 3 brings the results of this investigation to bear on the traditional question, sketching an argument from the premise that essentialist facts are explained by the (...) origins of things to the conclusion that such facts are active.
